Constructive Dismissal: Legal Parameters and Practical Considerations

What is constructive dismissal (in French, le congédiement déguisé) and why do HR managers need to know about it? This session will discuss the legal fiction known as constructive dismissal and will analyze the six indicators that an employee has been constructively dismissed, whether in a disciplinary or administrative context. Using recent case law examples, the session will provide an overview for HR managers to spot situations of constructive dismissal, as well as discuss possible strategic responses. This session will be presented a combination of French and English.
